Code of Conduct

Introduction

Chadron State College emphasizes both academic standards and a sense of community within this educational environment. Students are expected to maintain the principles of academic integrity and to respect themselves and others in their academic and personal endeavors. Individual responsibility in maintaining high standards of behavior is essential to the intellectual and personal growth of all members of this community.

Chadron State College students are subject to the duties acquired through involvement and participation in the academic community. Students are entitled to the rights and protections granted to them through their membership in this community. Students may also become subject to enforcement of civil laws by the proper authorities.

Violations of the law, affecting Chadron State College's academic objectives may result in the enforcement of these regulations regardless of civil charges filed outside the College.

Disciplinary action taken by Chadron State College is permitted outside of any action taken by civil authorities when a violation has been committed on campus property. Violation of the law occurring off campus may result in enforcement by civil authorities, as well as College authorities.

The following definitions shall apply to the Chadron State College Code of Conduct.

Student
Any individual taking at least one course on the campus or maintaining a relationship with Chadron State College such as completion of work from a previous semester while not officially enrolled at the time of the alleged misconduct.
Member of the Chadron State College community
Any individual who is a student, faculty or staff member, College official or any other person employed by the College.
College
Chadron State College.
Campus
All land, buildings and facilities either owned, used or controlled by Chadron State College. Including student housing and the thoroughfares which are adjacent to the above.
Student housing
Any College residence hall or student housing facility recognized by the College.
Organization
Any student group sanctioned by Chadron State College pursuant to policy relating to student organizations.
Hazing
Any action by an organization or a member of that organization in which a member or prospective member is subjected to acts which cause harm or create the risk of harm to the physical or mental well-being of the individual.
Misconduct
Any act which is a violation of standards of student conduct contained in this Code of Conduct or any other College policy and regulation.
Unlawful or Illegal
In violation of municipal, state, and federal laws and regulations.
Alcoholic beverage
All liquid or solids containing alcohol, which are capable of being consumed by a human being.
Drug
Any controlled substance included in Neb.Rev.Stat 28-405 (1989 Reissue) and regulated under Nebraska criminal laws.
Jurisdiction
Any case of alleged misconduct by any student or organization occurring on campus, in student housing, or at an off–campus event sponsored by the College or a College organization.
Disciplinary proceedings
Action taken by the College, independent of civil or criminal proceedings.
Warning
A written notice to a student or organization that future specified misconduct of a repetitive or continuing nature may be cause for other disciplinary action.
Restitution
Reimbursement, monetary and other, for damages to or misappropriation of property or the payment of medical expenses incurred as a result of misconduct.
Probation
A specified period of time during which a student or organization is prohibited from activities or undergoing conduct scrutiny.
Behavioral requirement
Specific conditions which must be met by a student or organization.
Suspension
Exclusion from some or all College classes, activities and privileges for a set period of time.
Expulsion
Permanent suspension of student– or organizational–standing.
Referral to civil authorities
The referring of acts of misconduct to appropriate civil or criminal justice officials.  

 

The following are specific examples of personal misconduct, for which disciplinary action may be taken by College authorities: (these examples are not exclusive to others).

A. General Provisions

  1. Lewd, indecent, disorderly, or obscene conduct at a College-sponsored event or on College property.
  2. Discriminating because of age, race, color, disability, religion, sex, sexual orientation, national origin, or any form of sexual harassment.

B. Alcohol and Drug Possession/Use

  1. Chadron State College recognizes that the use and abuse of alcohol and drugs interferes with the educational goals of students. CSC is dedicated to maintaining a drug-free environment.
  2. Illegally possessing, consuming or manufacturing of alcohol or drugs on property or at College-sponsored events. An exception will be made for prescription drugs.
  3. Being under the influence of alcohol or illegal drugs on College-owned property or at College-sponsored events.
  4. Using, possessing or distributing drug paraphernalia on College-owned property.

C. Disturbing or Interfering with College Business

  1. Disrupting meetings or any teaching environment including research or administrative committees or boards.
  2. Obstructing any authorized College organization or activity taking place on College property.

D. Unauthorized Entry/Use of Facilities

  1. Entering or using College facilities without authorization.
  2. Possessing, manufacturing, duplicating any key for College buildings, without proper authority.

E. Theft and Vandalism

  1. Intentional damage, defacement, destruction or theft of College property, or property of another person on College property.

F. Use of College Documents

  1. Giving false or misleading information for College records or student identification cards.
  2. Forging signatures or otherwise altering official College documents.

G. Fire

  1. Setting or causing a fire on any College property.
  2. Initiating false report or threat of fire, bombs, or explosives.
  3. Setting off a fire alarm in an event other than a true emergency.
  4. Tampering with, or damaging, fire safety equipment or devices.

H. Firearms / Explosives / Weapons

  1. Using, possessing or selling fireworks, explosives on College-owned property.
  2. Using or possessing any dangerous weapon, firearm, or ammunition on College-owned property (see Residence Hall Handbook section for procedure of storing firearms on campus).
  3. The unauthorized possession or use of flammable or other hazardous materials on college-owned property.

I. Solicitation

  1. Selling or offering any property or service and/or receipt of or request of any gift or contribution on College property. An exception will be made for cases involving fund raisers held by officially-sponsored campus clubs.

J. Misuse of Computer Facilities

  1. Borrowing or lending of an account number.
  2. Using account numbers or computer facilities for unauthorized purposes.
  3. Storing or deleting programs on College computers except when authorized.
  4. Destroying, altering, or copying any file or output of another person's, without that person's written permission.
  5. Copying of any copyrighted material.
  6. Intentionally misusing or abusing computer facilities so as to cause harassment, disturbances, or damage.

K. Aggressive Behavior

  1. Physically or verbally threatening or endangering another person or their environment on College property or at a College-sponsored event.

L. Sexual Assault and Sexual Harassment

  1. Sexual harassment is defined as any unwanted communication of a sexual nature, whether verbal, physical, written, or pictorial, which has the purpose or effect of intimidating the person receiving the communication or any solicitation of sexual contact of any nature when submission to or rejection of such contact is used as the basis for either implicitly or explicitly imposing favorable or adverse terms and condition of employment or academic standing.
  2. Sexual assault and rape, which is defined as inflicting sexual contact or sexual intrusion upon or engaging in sexual penetration with any person without that person's consent, is prohibited. For purposes of this section, "without consent" means when no clear consent is given; when inflicted through force, threat of force or coercion; or when inflicted on a person who is unconscious or otherwise without physical or mental capacity to give consent, (e.g. when someone is under the influence of alcohol or drugs).
  3. Students are subject to Chadron State College's "Sexual Harassment Policy." Violations of the standard of conduct established by that policy are prohibited.
  4. Sexual harassment is an attempt to coerce a person into a sexual relationship, or to subject a person to unwanted sexual attentions or demands, or to punish or retaliate for refusal to comply with sexual demands. Sexual harassment may consist of requests or demands for sexual favors, unwelcome physical advances, or conduct (verbal or physical) of a sexual nature that is intimidating, demeaning, hostile or offensive. Whether a specific incident constitutes sexual harassment is not always clear. Some behaviors, such as a demand for sexual favors in exchange for a promotion or better grade, are clearly prohibited, and one such incident shall be grounds for disciplinary action. Other behaviors, such as behavior persists despite an indication by the recipient that it is unwelcome.
